Tour Conditions Agreement

I am an applicant for a travel program sponsored by Travel Systems Abroad Inc. (TSA) and agree to the following understandings binding upon myself and upon TSA.

  1. Travel Systems Abroad, Inc. is responsible only of the acts or omissions of its own employees. Each program begins with the takeoff of the international flight and ends upon the completion of the return flight to the US (except for land-only travel arrangements, which start at the first hotel and end with completion of services at the last hotel). TSA cannot be responsible for events beyond its control, such as (without limitation) acts of God, war, strikes or government restrictions: nor in the absence of its own negligence, for personal injury, death or property damages or delay caused by persons not controlled by TSA, such as (without restriction) airlines, bus companies, railways, and hotels. No responsibility is incurred by TSA for loss of passports, airline tickets, or other travel documents, loss or damage to luggage or any other participants' belongings, or for consequential damages such as (without limitation) lost wages. TSA will not be liable for consequential damages in any event. TSA reserves the right to cancel any participant at any time for reasons that appear to TSA to be valid in its sole judgment. TSA shall have the right, with our refund, to send home, at his/her own expense, and without escort, any participant who appears to have abused drugs or alcohol, or engaged in any illegal or disruptive conduct. I agree to release TSA, its agents and employees from all claims arising out of such events, acts, or omissions.

  2. The air carrier's liability for loss or damage to baggage is limited to its value but shall not exceed approximately $9.07 per pound for checked baggage and $400 per passenger for unchecked baggage. The air carrier assumes no liability for fragile or perishable articles. Excess valuation may not be declared on certain types of valuable articles. Higher limits of liability may be obtained for the carrier by paying the charge contained in the carrier's tariffs, or optional baggage protection insurance can be purchased. I also understand that the air carrier's liability of death or injury is limited by their tariffs and/or the Warsaw Convention.

  3. TSA is not responsible for my well-being when I am absent from TSA supervised activities or on a visit to friends or relatives. I also accept liability for any financial obligations I may incur or any damage or injury I may cause while participating in a TSA program.

  4. If I become ill or incapacitated, TSA may take whatever action it deems necessary to preserve my health and safety including, without limitation, obtaining medical treatment for me at my expense, and/or transporting me at my own expense back to my home for medical reasons. I agree to pay any extra expenses incurred on my behalf by my tour director or other group members for medical or other reasons. If my tour director or other group members have paid such expenses, I will reimburse them. I also understand that trip health/accident insurance is provided but I will receive compensation only upon proper filing of a claim.

  5. Any film or video likenesses taken of me while participating in a TSA program and any of my comments or statements may be used in future materials published by TSA.

  6. If I wish to cancel my reservation in a TSA program, I must do so in writing. The refund I will be entitled to will be as explained in the "Cancellation and Refund Policy" section of the TSA Program Brochure. I have no right to refund for any accommodations, meals, or services I do not use once my tour has begun. Prices are subject to adjustment in accordance with the fluctuations of these considerations. If tour price increases more than 10% of total cost, participants may cancel with full refund.

  7. TSA program fees are based on exchange rates, air fares, and overseas costs in effect at the time of printing and are subject to increase to reflect subsequent increases in the costs. (EARLY BIRD participants, however, are protected against any and all price surcharges that can result from increases in airfares, overseas inflation, exchange rates or airline fuel surcharges. Each group is priced on a minimum number of participants. The price guarantee does not cover a surcharge if your group should fall below the minimum number. Government taxes imposed after the printing date are also not covered in the guarantee.) TSA also reserves the right to assign participants to available departure/arrival cities and dates, to use charter flight, and to modify the itinerary, such as changing the order in which the various cities are visited or substituting alternate but nearby cities during peak travel periods.

  8. Your agreement with TSA cannot be modified except in writing by the TSA Tempe office; or oral modification shall have any validity.

  9. TSA and the air carrier have the right to substitute airlines, to make changes in equipment, in the published itinerary, in the departure and arrival dates, times, or cities, or to alter the itinerary (such as reversing the order in which the various cities are visited), and I agree to accept any such changes. No refunds will be made in the event of changes in the itinerary occurring prior to or after departure. TSA will attempt to furnish alternate services or accommodations. Those departure cities shown on the program brochure may not provide direct air service to your overseas destination; it may be necessary to connect through some other US or foreign airport.

  10. I certify that I have read the "Terms and Conditions" section of the Descriptive Program Brochure and agree that all conditions stated are fully incorporated in this agreement. I further understand that this agreement will be effective only upon my acceptance by TSA as a participant in one of its programs.

  11. I am responsible for obtaining and carrying a current passport, and if I am not a US citizen, the appropriate visas for countries I am to visit. I understand that the inability to obtain these visas and other documents does not constitute grounds for withdrawal with refund.
